IN CONSIDERATION for being given the opportunity to participate in this Nourishing Food For Thought Inc. and/or Jupiter Creamery LLC (together, the “Creamery”) event, I, the undersigned, my personal representatives, heirs and next of kin, estate, assigns, and/or legal guardians (together, the “Participant”)  hereby acknowledge that

1. the Participant has voluntarily applied to engage in potentially hazardous and inherently dangerous activities, including, but not limited to cow washing, petting, feeding and/or tasting raw milk at the Creamery; 
    

2. the Participant understands the above-mentioned activities and/or other similar activities that may occur at the Creamery involve numerous unavoidable and inherent risks of injury, including, but not limited to slips, falls, collisions and/or obstacles, and assumes full responsibility for all such risks, including and up to death;
    

3. the Participant understands that animals are unpredictable, irrespective of past training and characteristics, and assumes full responsibility for all such inherent risks of injury, including and up to death, that flow directly or indirectly from an animal’s bite, scratch, kick, bump or any other act on the Creamery premises;
    

4. the Participant understands that variations in terrain on the Creamery premises, including, but not limited to growths, debris, rocks, other hazardous surfaces and/or subsurface conditions and obstacles, whether apparent and non-apparent, man-made or natural, involve numerous inherent risks of injury, and thereby assumes full responsibility for any such risks, including and up to death; 
    

5. Under Florida law, an agritourism operator is not liable for injury or death of, or damage or loss to, a participant in an agritourism activity conducted at this agritourism location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss. You are assuming the risk of participating in this agritourism activity.
    

6. I hereby grant the Nourishing Food For Thought Inc. and/or Jupiter Creamery LLC (together, the “Creamery”) permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.
    

7. in signing this Release, the Participant waives the right to take legal action against the Creamery or any of its representatives, directors, officers, animal owners, members, affiliated organizations, landowners, agents, employees, and/or volunteers for any injury or death caused directly or indirectly by any of the risks described in ¶¶ (I)-(IV) above;
    

8. in the event a court finds any part of this Release unlawful and/or unenforceable, the remaining parts of this Release shall remain in full force and effect; 
    

9. any legal action or claim not barred by this Release shall be restricted to the jurisdiction of Palm Beach County, Florida; and
    

10. this Release shall be legally binding upon the Participant, and the Participant has carefully read and understood its contents, including the release of certain legal rights, before voluntarily signing below.
